The website www.purvintage.com (hereinafter the “Platform”) is an initiative of Swight srl, Rue de la Gare 25, 5170 Lustin, Belgium, company number (BCE/VAT) BE 0640 819 513, email: hello@purvintage.com (hereinafter “Swight srl” or the “Seller”).
I. GENERAL TERMS OF USE
- Scope
These general terms and conditions of use (hereinafter referred to as the "Terms") apply to any visit to or use of the Platform and its information by an internet user (hereinafter referred to as the "User"). By visiting or using the Platform, the User acknowledges having read these Terms and expressly accepts the rights and obligations set forth therein. Exceptions to the provisions of these Terms may be made by written agreement. Such exceptions may consist of modifying, adding to, or deleting the clauses to which they relate and shall not affect the application of the other provisions of these Terms. Swight srl reserves the right to modify these Terms at any time, without prior notice, it being understood that the applicable provisions are those in effect at the time of use of the Platform.
- Platform
a. Access and navigation
Swight srl takes all reasonable steps to ensure the proper functioning, security, and accessibility of the Platform. However, no guarantee of absolute operability can be offered. Use of the Platform is at the User's own risk. Swight srl shall not be liable for any damages resulting from malfunctions, interruptions, defects, or harmful elements present on the Platform. Swight srl reserves the right to restrict or interrupt access to the Platform at any time without prior notice.
b. Content
Swight srl determines the content of the Platform and takes particular care to ensure the accuracy of the information contained therein. Despite efforts to maintain complete, accurate, and up-to-date information, no absolute guarantee can be given. Swight srl shall not be liable for any direct or indirect damages resulting from the use of the information on the Platform. All downloads are at the User's own risk, and the User remains solely responsible for any damage caused to their computer system or for any data loss. Any illegal content or content that infringes on the rights of third parties may be reported by email so that appropriate action can be taken.
c. Services reserved for registered Users
- Registration
Access to certain services requires prior registration. Registration is reserved for legally competent individuals who have completed the online form and accepted these Terms and Conditions. The User agrees to provide accurate, truthful, and up-to-date information, and to keep it correct. Only one registration per person is permitted. Login credentials are strictly personal and confidential. Swight srl reserves the right to refuse any registration that does not comply with these Terms and Conditions.
- Unsubscribe
The User may request to unsubscribe at any time via their personal account. This will take effect as soon as possible after validation of the request.
d. User-generated content
The User agrees to comply with applicable laws and remains solely responsible for the content they publish. Swight srl reserves the right to moderate, modify, or delete any content without justification or notice. By publishing content, the User grants Swight srl, free of charge, on a non-exclusive, worldwide basis, the right to use that content in any medium.
- Links to other websites
The Platform may contain links to external sites over which Swight srl has no control and for which it disclaims all responsibility.
- Intellectual property
All elements comprising the Platform are protected by intellectual property laws. Any unauthorized use is strictly prohibited. The User has a limited, personal, and non-commercial right of use.
- Protection of personal data
Personal data is collected and processed by Swight srl in accordance with applicable legislation and the Privacy Policy available on the Platform.
- Applicable law and jurisdiction
These Terms and Conditions are governed by Belgian law. Any dispute will be submitted to the competent courts within the jurisdiction of Swight srl's registered office.
- General provisions
Swight srl reserves the right to modify or discontinue all or part of the Platform. The invalidity of any provision shall not affect the validity of the remaining provisions.
II. GENERAL TERMS AND CONDITIONS OF SALE
- Scope
These general terms and conditions of sale (hereinafter referred to as the "Terms and Conditions") define the rights and obligations of the parties in connection with the sale of products or services via the Platform. Any order implies unreserved acceptance of the Terms and Conditions.
- Online store
Products and services are presented with the utmost care, subject to availability. Photographs are not contractually binding.
- Price
Prices are shown in euros, inclusive of all taxes, excluding delivery charges. The applicable rates are those in effect at the time of the order.
- Order online
Order confirmation constitutes acceptance of prices, descriptions, and terms and conditions. The Seller reserves the right to suspend or cancel any order in case of problems.
- Payment and confirmation
Payment is due immediately. The order is confirmed by email. The Seller retains ownership of the goods until full payment is received.
- Delivery
The products are delivered to the address provided by the Customer within the estimated delivery time specified at the time of ordering. No compensation can be claimed in the event of a delay.
- Returns and cancellations
The customer has a 14-day right of withdrawal, in accordance with the law. Return shipping costs are the responsibility of the customer.
- Guarantees
The products benefit from the applicable legal guarantees, with specific time limits for second-hand goods.
- Force majeure
In the event of force majeure, the performance of obligations may be suspended without liability.
- Applicable law and jurisdiction
These Terms and Conditions are governed by Belgian law. Any dispute will be subject to the jurisdiction of the competent courts of the Seller's registered office.
